Decision Summary

 
On 25 February 2025, the Office of the Migration Agents Registration Authority (the Authority) decided to cancel Agent Mr Sean Lee from being registered as a migration agent for a period of five years, following an investigation into one complaint regarding the Agent’s conduct.

The Authority found that the Agent breached his obligations under subsection 13(1)(d), sections 13(2), 17, 26(1), 32, 35 and 56 of the Code of Conduct for Registered Migration Agents.

The Authority found that the Agent:
• Made misleading, deceptive or inaccurate statements and otherwise acted dishonestly;
• Attempted to distance himself from his personal responsibilities, as an RMA, by failing to respond in full or within the prescribed manner to the Authority’s request pursuant to section 308 of the Act;
• Acted without regard for the adverse impact the conduct would have on the reputation of the migration advice industry.

The Authority was also satisfied that the Agent was not a person of integrity, or otherwise not a fit and proper person to give immigration assistance.
