---On 22 April 2021, the Authority decided to cancel the registration of Registered Migration Agent Rajiv Luthra (MARN: 0929019) following an investigation into five (5) complaints in relation to the Agent’s conduct.
The Authority was satisfied that the Agent breached clauses 2.1, 2.3, 2.4, 2.8, 2.9, 2.9A, 2.17, 2.18, 3.2, 5.2, 5.5, 6.1, 6.1A, 7.2, 7.4 and 7.5 of the Code of Conduct for Registered Migration Agents and was not a person of integrity nor a fit and proper person to provide immigration assistance.
The Authority was satisfied that the former agent: took on clients and accepted their money in advance but did little or no work to act on their instructions; misappropriated client monies; repeatedly failed to communicate with his clients in a timely manner; was dishonest, and avoidant towards his clients to conceal the fact that he had not undertaken work for which he had received payment; repeatedly failed to keep his clients informed of the progress of their matters; neglected his overriding duty to act in the legitimate interests of his clients which has resulted in the loss of visa opportunities and in some cases the clients having to depart Australia; and promised refunds to some clients but has taken little action to effect such refunds and attempted to mislead the Authority in the process.
