Decision Summary

 
On 29 April 2026 the Office of the Migration Agents Registration Authority (the Authority) decided to suspend the Agents’ registration as a migration agent under subparagraph 303(1)(b) of the Act. The Agents’ registration has been suspended for a period of six months, and until he has met specified conditions.
The Authority was satisfied that the Agent breached his obligations under section 13(1), 13(2), 18(1)(a), 25(3), 25(4), 33(a)(i), 33(a)(iii) and 57 of the Code of Conduct.
The Authority found that the Agent:
• Failed to act professionally, ethically and with integrity and in doing so damaged the reputation of the migration advice industry.
• Allowed another person to use his MARN in a way that suggested that immigration assistance given by another person was given by him.
• Acted in a way that defeated the purpose of migration law by aiding in the provision of immigration assistance by an unlawful provider.
• Failed to notify the Authority within 14 days of him becoming aware that his MARN was being used by another person.
• Failed to act in the legitimate interests of his clients and in accordance with the relevant service agreement.
• Failed to notify his clients and the Department that he had ceased his representation.
