Decision Summary

 
On 6 January 2020, the Office of the Migration Agent Registration Authority (the Authority) suspended the registration of migration agent Hee Kyoung Kim (MARN 1573593) for a period of 24 months, and until certain conditions are met. Following an investigation into five complaints regarding the Agent's conduct, the Authority was satisfied that she had breached clauses 2.1, 2.9A, 2.22B, 3.1, 3.5, 6.1, 6.1A, 8.1, 8.2, 8.3 and 9.3 of the Code of Conduct for Registered Migration Agents (the Code).

The Agent was found to have repeatedly attempted to mislead the Authority during its investigation and to have provided false and misleading information in statutory declarations, in breach of the law, with regards to her knowledge and association with an individual who was not a person of integrity. The Agent was also found to have repeatedly failed to comply with requests for information and documents by the Authority pursuant to section 308 of the Act, in order to evade culpability for her conduct. Further, the Agent failed to exercise effective control and proper supervision of employees in her workplace, resulting in someone who was not registered providing immigration advice and assistance, failed to protect her clients’ confidentiality, and breached multiple professional obligations including maintaining proper records of her interactions with her clients.

The Authority was satisfied that the Agent was not a person of integrity and not a fit and proper person to give immigration assistance.
