Decision Summary

 
On 14 November 2024, the Office of the Migration Agents Registration Authority (the Authority) decided to cancel the registration of Registered Migration Agent (RMA) Mrs Thu Ngoc Bannan (MARN 0964816) following an investigation into three complaints about the Agent’s conduct.

The Authority is satisfied that the RMA breached her obligations under sections 13, 14, 15, 17, 29, 32, 33, 34, 39, 40, 42, 50, 51, 52, 54 and 56 of the Code.

The Authority found that the RMA:

• Failed to act in accordance with the law and the legitimate interests of her clients;
• Retained a substantial amount of client monies without entitlement;
• Displayed a significant conflict of interest by putting her personal financial interests ahead of the interests of her clients;
• Failed to act professionally and respectfully;
• Failed to provide Service Agreements, invoices and receipts to her clients;
• Failed to maintain client files and to return client documents upon request;
• Failed to respond to her clients in a timely manner;
• Made misleading, deceptive or inaccurate statements and otherwise acted dishonestly; and
• Acted without regard for the adverse impact the conduct would have on the reputation of the migration advice industry.

The Authority was also satisfied that the Agent and was not a person of integrity, or otherwise not a fit and proper person to give immigration assistance.
