Decision Summary

 
On 24 September 2020 the Office of the Migration Agents Registration Authority (the Authority) cancelled the registration of migration agent Ms Christina CHANG (MARN 9254751). Following an investigation into three complaints, the Authority found that Ms CHANG had not demonstrated that she possessed the knowledge, trustworthiness and character required of a registered migration agent and necessary to fulfil her responsibilities. The Authority found that Ms Chang:
- Did not deal with her clients in a competent, diligent and fair manner by lodging applications with no prospects of success and unnecessarily increasing costs to the clients.
- Lacked consideration for her clients’ interests, causing each client financial loss and considerable stress,
- Caused a significant detriment to her clients in that they lost their opportunities to work and gain permanent residence in Australia.
- Failed to respond to the complaints made by her clients.
The Authority also found that Ms Chang failed to declare in her applications to renew her registration that she was subject to investigation by the Legal Profession Board of Western Australia, and subsequently subject to disciplinary action as a result of that investigation.
The Authority was satisfied that Ms Chang had engaged in conduct in breach of her obligations under clauses 2.1, 2.3, 2.4, 2.8, 2.17, 2.19, 5.2, 5.3 and 9.3 of the Code and was not a person of integrity or is otherwise not a fit and proper person to give immigration assistance. On 12 August 2022 the Administrative Appeals Tribunal dismissed the Agent's application for review of the cancellation decision because she had repeatedly failed to comply with Tribunal directions
