Decision Summary

 
On 26 August 2026, the Office of the Migration Agents Registration Authority (the Authority) decided to cancel the registration of Mr Harsh Yadav (MARN: 2117646) following an investigation into the Agent’s conduct.

The Agent must not be registered for a period of five years from the date of the decision.

The Authority was satisfied that the Agent breached his obligations under sections 13, 15, 17, 18, 20, 23, 24 and 32 of the Migration (Migration Agents Code of Conduct) Regulations 2021 (the Code).

The Authority found that the Agent:
• Did not notify the Department that he had provided immigration assistance, as required under section 312A of the Act.
• Acted in a way that was intended to evade a requirement of the migration law by providing immigration assistance without notifying the Department.
• Knowingly provided false and misleading statements to the Department in support of visa applications.
• Engaged in conduct that was reasonably likely to damage the reputation of migration agents and the immigration advice industry.
• Failed to fully respond to requests made by the Authority.
• Failed to take reasonable steps to ensure that immigration assistance in his business was provided only by registered migration agents.
• Failed to take reasonable steps to ensure the quality, accuracy and timeliness of work performed by persons assisting him to provide immigration assistance.

The Authority was also satisfied that the Agent was not a person of integrity, or otherwise not a fit and proper person to give immigration assistance.
