On 22 May 2025, the Office of the Migration Agents Registration Authority (the Authority) decided to caution Registered Migration Agent (RMA) Mr Muthutantri Fernando (MARN: 0214726) for a period of six months following an investigation into a complaint regarding the Agent’s conduct.

The Authority found that the RMA breached his obligations under clauses 2.1, 2.1B, 2.4, 2.8, 3.1, 5.2, 5.5, 6.1, 6.1A, 7.2, and 7.4 of the former Code of Conduct for Registered Migration Agents (the former Code) as in force prior to 1 March 2022.

The Authority found that the RMA:

- Failed to seek and act on his client’s instructions prior to notifying the Department of a change in circumstances for her visa application.
- Acted without due regard for his client’s dependence on his knowledge and experience to act in her legitimate interests.
- Failed to avoid a conflict of interest by acting in the sponsor’s interests only.
- Failed to maintain client confidentiality.
- Failed to fulfil financial obligations.
- Failed to maintain proper records.
- Failed to act diligently to provide accurate and timely advice about matters in relation to his client’s visa application despite prior warnings from the Authority on two occasions about comparable matters.
