Decision Summary

 
On 28 May 2025, the Office of the Migration Agents Registration Authority (the Authority) decided to bar the Former Agent Mr Mohamad Salah Diab (MARN: 1462262) from being registered as a migration agent for a period of 12 months following an investigation into a complaint regarding the Agent’s conduct.

The Authority found that the Former Agent breached his obligations under sections 13, 19, 32, 33, 40, 51, 53, 55 and 56 of the Code of Conduct for Registered Migration Agents (the Code) which came into effect on 1 March 2022.

The Authority found that the Former Agent:

• Knowingly lodged visa applications which had little or no prospects of success.
• Failed in his duty to act professionally, competently and diligently during his dealings with his clients, the Department and the Authority.
• Failed to have regard to his client’s dependence on his knowledge and experience.
• Was in receipt of funds from a client prior to a service agreement being in force and caused unnecessary expenses to be incurred by his clients.
• Failed to respond to requests from the Authority to provide information and or documents.
• Failed to both create and maintain client files, including making records of any oral communications with his clients and to also keep his clients documents secure.
